Terms of Service     

The Company is of the opinion that the Contractor has the necessary qualifications to perform services on behalf of the Company and the Contractor desires and agrees to perform those services under the terms and conditions set out in this Agreement. In consideration of the matters described above and of the mutual benefits and obligations set forth in this Agreement, the receipt and sufficiency of which consideration is hereby acknowledged, the parties to this Agreement agree as follows:

Commencement Date and Term:

1. The Contractor will enter into this Agreement and commence provision of the services detailed in this Agreement beginning on the Effective Date.

2. The Contractor will continue to provide the Services detailed in this Agreement until the Agreement is terminated as specified in this Agreement (the “Term”).

Job Title and Description:

3. The Contractor will be delivering orders on behalf of the Company. This (the “Services”) will include the following:

-regularly updating and using the App.

-picking up orders from the locations according to the App.

-delivering those orders as designated by the App.

4. The Contractor is solely responsible for the proper handling of orders. Orders are to be delivered in the exact packaging that they appear in when provided to the Contractor.

5. Orders are to be delivered in a timely fashion

Eligibility

6. In entering into this Agreement the Contractor confirms their eligibility by agreeing that they meet the following criteria:

-the Contractor is at least 18 years of age at the Effective Date.

-the Contractor currently has a valid driver’s license and will keep a valid driver’s license for the duration of this Agreement.

-the Contractor has a clean driving record. If the Contractor has any infractions, suspensions, limitations, or criminal charges associated with their driving record or driver’s license, it is the responsibility of the Contractor to provide this information to the Company, and it is fully at the discretion of the Company as to whether or not the Contractor is eligible for this Agreement; furthermore, if the driver is found to have withheld any information concerning the eligibility for the contracting of their services under this provision, before the Effective Date or during the Term of this Agreement, the company reserves the right to terminate this Agreement.

-the Contractor will operate an insured vehicle and will both keep valid insurance and proof of insurance for that vehicle at all times while providing the Services.

-the Contractor is required to own a smartphone and will be responsible for downloading the most recent version of the App.

-the Contractor is required to provide an insulated bag for the transportation of orders. This insulated bag must be approved by the Company.

Conduct

7. While providing the Services, the Contractor is acting on behalf of and representing the Company; therefore, it is the responsibility of the Contractor to conduct the Services with candour and to positively represent the Company and any Parties associated with provision of the Services. 

8. The Contractor is responsible for upholding all current provincial regulations with regards to Covid-19 restrictions. This includes, but is not limited to, wearing masks, sanitizing frequently, and practicing safe social distancing.

9. All physical or verbal harassment, assault, or abuse is strictly prohibited, and, should any reports be made suggesting that the Contractor was involved in any aggressive behaviour while representing the Company, it may result in the termination of the Contractor.

Compensation

10. All monetary values included in this Agreement are in Canadian Dollars (CAD).

11. Compensation will be paid to the Contractor for the Services in the form of Commission (the “Commission”) according to the terms that follow:

-the gross charge to each individual patron for the delivery of an order will be the cost of the order’s products, a $3.00 delivery fee, and an additional $0.25 per km travelled by the Contractor to complete the delivery (the “Gross”).

-the driver will receive 75% of the Gross for each completed delivery.

-the Gross may be subject to penalties

12. This Compensation will be paid to the Contactor by the Company every week during the Term of this Agreement. 

13. The Company is entitled to deduct from the Compensation any applicable deductions or remittances required by law or in accordance with any applicable penalties; however, the Contractor is not employed by the Company and the Company will not deduct any applicable taxes owing on the Compensation. It is the sole responsibility of the Contractor to pay all applicable taxes on the Compensation.

14. bonus incentives can take up to 14 days to process

Driver referral incentives 

1. When referring another driver, to qualify for the incentive you must be online 10 hours minimum weekly with a 60% acceptance rating.

2. Acceptance rating is calculated within the last 10 order requests received.

3. Online hours must be within 7:00am-8:00pm Monday to Wednesday, Sundays and 7:00am-10:00pm Thursday to Saturday.

Termination

14. The Company reserves the right to terminate this Agreement at any time in the result of any of the following:

-the Contractor’s driver’s license is suspended, expired, or terminated.

-the Contractor’s vehicle is no longer insured.

-the Contractor is found to have withheld information concerning any infractions, suspensions, limitations, or criminal charges associated with their driving record or driver’s license.
